Terms of Service for Evna
Introduction
Welcome to Evna, a platform for paid video calls between service providers and consumers. By accessing or using our platform, you agree to be bound by these Terms of Service ("ToS"). If you do not agree with any part of these ToS, you must not use the platform.
Please read these Terms carefully, as they contain important information about your legal rights, remedies, and obligations. If you do not agree to these Terms, you may not access or use the platform.
User Categories
Our platform has two categories of users:
- Service Providers: Individuals who offer paid video call services to Consumers.
- Consumers: Individuals who pay Service Providers for video call services.
Users and Registration
To use our platform, you must create an account and provide accurate, complete, and up-to-date information. You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater, to use the platform. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.
Fees and Payments
Service Providers set their own rates per minute for video calls in US dollars. Rates can be changed at any time at the Service Provider's discretion. All payments are processed using a third-party payment processor. By making a payment, you agree to the payment processor's terms of service and privacy policy.
The platform charges a transaction fee for each occurred video call. The fee is subject to change at any time without prior notice.
Acceptable Use
You agree not to use the platform for any illegal, harmful, or offensive activities, including but not limited to:
- Harassment, threats, or discrimination
- Sharing explicit or offensive content
- Violating intellectual property rights
- Engaging in fraudulent or deceptive practices
- Any other activities deemed inappropriate by Evna
- Sharing, transmitting, or promoting pornography, explicit sexual content, or any content that is intended for adult audiences
Disclaimer of Limitation of Liability
You are solely responsible for your conduct while using the platform and for any content you provide, including any text, images, videos, or other materials. You agree not to use the platform for any unlawful purposes or in any way that violates these Terms.
We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for lost profits, goodwill, use, or data, resulting from your access to or use of the platform, even if we have been advised of the possibility of such damages.
We are not liable for any mistreatment, disputes, or other issues that may arise between users of the platform. We do not endorse or assume responsibility for any content, advice, or opinions provided by users. By using the platform, you agree to release us from any and all liability arising from your interactions with other users.
We are not responsible for the actions or content of users, including any disputes that may arise between you and other users. If you have a dispute with another user, you agree to release us from any claims, demands, and damages arising out of or in connection with such dispute.
Evna is not responsible or liable for any interactions or disputes between Service Providers and Consumers. Users agree to release Evna from any claims, damages, or liabilities arising from any mistreatment or misconduct by other users.
You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the platform, your violation of these ToS, or your infringement of any third party's rights, including but not limited to intellectual property rights and privacy rights.
Governing Law and Dispute Resolution
These ToS shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising out of or relating to the use of the platform or these ToS shall be resolved in the state or federal courts located in California. By using the platform, you consent to the exclusive jurisdiction and venue of these courts.
Changes to ToS
Evna may revise these ToS at any time, at its sole discretion. The updated ToS will be effective upon posting. By continuing to use the platform after any changes to the ToS, you agree to be bound by the revised terms.
Account Termination
Evna reserves the right, at its sole discretion, to deactivate, suspend, or terminate the account of any user found to be misusing the platform or violating these ToS, without prior notice or liability.
